Today, February 3rd, the last hearing before the verdict in the appeal trial for the demonstration against borders (Brennero, May 2016) took place in the court of Bolzano. This is the declaration that was read out in court, signed by some twenty accused:

If there is one place where words do not express mere opinions devoid of consequences it is a court. In a few days, in this courtroom, it will be decided whether and for how long our future will be one of bars and prison.

In the repressive doggedness that the various public prosecutors’ offices of this country have long reserved for the anarchist movement – of which the 130 years’ imprisonment dispensed in the first-instance verdict of this trial is a good example – is reaching its peak at the moment. The State seems determined to condemn anarchist comrade Alfredo Cospito to death, today on his 107th day of hunger strike to the end against the torture of 41 bis and against life imprisonment without appeal. Alfredo’s determination, on the one hand, and institutional ferocity on the other, decisively overshadow the outcome of this trial and our individual fates.

Unknown individuals set fire to a police vehicle. At about 6:30 p.m. on Saturday, January 28, a passerby discovered the flames in a parking lot on Rudolstädter Straße in the Wilmersdorf district of Berlin. Police Station #26 was nearby, and their vehicles were parked there.

A police spokesman said that “firefighters extinguished the flames inside the van, whose side window had been broken,” preventing the flames from spreading to other adjacent police vehicles. The State Security (Staatsschutz) was in charge of the investigation.

As many imprisoned comrades worldwide before me, I want to send words in solidarity with Alfredo Cospito from the prison Billwerder in Hamburg, Germany.

The italian state wants to bury an inconvenient anarchist alive in it’s
torture-isolation-prison.-system „41bis“. Alfredo is fighting with a
hunger-strike till the end against his situation and against 41bis in
total.

This is a continuation of a life full of struggle. Alfredos way
was also present here in the north. The attack against nuclear-boss
Adinolfi, the courtcase in Genua and Alfredos und Nicolas dignified
stand in it and also the written contributions over the years of

Concerning the request for annulment of the measure of 41 bis for Alfredo Cospito by the attorney general in view of the cassation hearing of 24th February

The newspapers of the Agnelli [Fiat] family (la Repubblica and la Stampa) revealed in this morning’s editions (12 February) that the attorney general at the court of cassation had filed for the hearing of the 24th of February a request for annulment of 41 bis with regard to Alfredo Cospito. This is undoubtedly good news, but it should not be overestimated. Naturally because as anarchists we have no faith in bourgeois justice, specifically because it is not uncommon for the cassation to make more radical decisions than those demanded by the prosecution itself.

Finally, we cannot forget that Alfredo’s clinical situation is very serious and that February 24th could be too far off. the whole thing could turn out to be a terrible hoax.
We are persisting in our demand for the immediate declassification of our comrade, convinced that any result achieved will depend solely on the fight to the last breath that Alfredo has put in play and by the international solidarity movement that has emerged.

In the course of the mobilizations in solidarity with the hunger strike of Italian anarchist comrade Alfredo Cospito, which has been going on for 104 days, today, January 31, anarchist and subversive prisoners held in the La Gonzalina-Rancagua Prison are beginning a solidarity fast. This is a minimal gesture of complicity in the face of such a transcendental and decisive struggle that the comrade is carrying out to end the isolation the Italian State has subjected him to and against his recent life sentence.

The situation is extremely urgent and there is no room for moments of waiting and reflection that only strengthen apathy and inaction.

Nor is it the time to be passive spectators while the Italian State lets Alfredo die, in one of the clearest demonstrations of authoritarian brutality.

Are we going to wait for our comrade to die before deciding to act?

Alfredo Cospito, detenuto anarchico a cui è stata imposta la legge del “massacre” nel caso “Scripta Manent”-sul doppio attentato alla scuola dei carabinieri di Fossano, firmato da FAI-RAT (Federazione Anarchica Informale – Rivolta Anonima e Assordante)-, è in sciopero della fame contro il regime del 41-bis e l’ergastolo permanente dal 20 ottobre nel carcere di Bancali, a Sassari, Sardegna. Già dal 5 maggio e dopo dieci anni di carcere, lo Stato scelse di rafforzare l’incarcerazione del compagno (che fino ad allora aveva dato un contributo significativo al discorso anarchico con lettere, articoli e interventi), attraverso il regime dell’articolo 41-bis (carcere duro), una legge mostruosa che, in sostanza, riqualifica la reclusione in isolamento speciale anche a livello intellettuale e sensoriale. Si tratta di un cordone soffocante che elimina quasi del tutto le comunicazioni e i contatti con il mondo esterno, come tortura di sterminio psicosomatico dei militanti/e per costringerli/e al “pentimento” politico.

Inoltre, questo regime intende creare una barriera al dialogo rivoluzionario-antiautoritario tra i compagii-le compagne all’interno e all’esterno delle carceri. La censura organizzata e il tentativo di eliminare l’ esistenza stessa dei prigionieri politici rivela i denti della democrazia e la paura delle forze di potere nei confronti di coloro che portano e diffondono i semi della rivolta e dell’attacco per la demolizione del mondo dello Stato e del capitale.

Unfortunately, the situation of our comrade has not changed much. Here’s a summary of some new developments after our last statement, published online last April.

Until now, we have always said that, from a legal point of view, one of the problems to be solved is a deliberate confusion about which penal code to be applied. The 1973 Code (which would give a sentence of 30 years, with the application of different remissions of sentence, accumulated over decades), in force at the time of the sentence for the events of 1990. Or the 1995 Code (which would give a sentence of 20 years, without the application of remissions), more favorable to the accused in terms of the length of the sentence. Remember that, in theory, they should always apply the Penal Code that is more in favor of the defendant, but we know what “always” changes depending on who the defendant is. Gabriel continues to be who he has always been and his determination, consistency and clarity certainly do not work in his favor.

Alfredo Cospito, on hunger strike for 115 days, was transferred this afternoon from Opera prison to San Paolo hospital in Milan, in one of the rooms reserved for prisoners in 41 bis. It seems that Alfredo has been admitted to the ward of penitentiary medicine of the Milanese hospital on indications of the doctors of the clinical centre of Opera where he had been since January 30th.

Alfredo Cospito’s critical health conditions had already been reported by Andrea Crosignani, doctor on his side who had visited him precisely this Saturday morning in the prison of Opera. “He weighs 71 kilos and chili ed è at risk of cerebral oedema and potentially fatal cardiac arrhythmias.” This is what Crosignani referred to the lawyer Flavio Rossi Albertini after his visit today. But Alfredo is determined to go ahead with the protest. He is lucid and walks on his own two legs.

Although I tried to convince him to take potassium again to reduce the risk of these arrhythmias. The parameters are holding, but it takes little for the situation to precipitate without any particular warning signs”.

«Against 41bis. For a world without prisons, freedom for everyone». This is the banner behind which the anarchist demonstration was held in Milan in solidariety with Alfredo Cospito, imprisoned under a «harsh prison» regime at the San Paolo hospital and on hunger for over three months. In over four hundred – most from Milan, – they set off just after 17.00 from piazza XXIV Maggio in the direction of viale Col di Lana, where the shopkeepers had pulled down the shutters to protect themselves against vandalism. In front, prima fila, with helmets on their heads, a group of demonstrators with a banner tied to plastic panels. At the start, a few water balloons were thrown from the march in the direction of the journalists. In Viale Bligny the first damages: the window of a bank and that of an estate agency were hit.

Paper bomb throwing and police charges.

Tension rose when the demonstration reached Porta Romana. Just before Piazzale Medaglie d’oro the police tried to stop the procession. The anarchists who tried to ‘break through’ the security cordon were repelled with shields and batons. A dense throwing of firecrackers and bottles followed. Then the police tried to channel the march along Viale Sabotino: the two sides came into contact several times. In the most agitated phases tear gas was also used, while the demonstrators threw paper bombs at the police.
