Brief update of the first day of the start of the “Ampelokipi case” trial

An objection was made for a political crime by lawyers Papadakis/Kambagiannis/Rachiotis/Paparousos, on the grounds that this court is incompetent and should be tried by a mixed jury as a political court and not under Article 187A. ( is  the Greek Penal Code (commonly referred to in Greece as the “Tromonomos” or “terror-law”) is a legislative provision dealing with terrorist acts and organizations.)

The objection is based on the invalidity and vagueness of the referral resolution. Specifically, the act of which they are accused under Article 187A is not specified at any point, nor which organization, Greek or international, was endangered, nor the time of establishment of the alleged “organization”.

Moreover, even countless expert reports cannot substantiate this.

There are 14 prosecution witnesses and 32 witnesses for the defence.

The trial is in the process of reading witnesses’ accounts.

A procedural objection was made regarding the state of health of the anarchist comrade Marianna Manoura when the first interrogation took place. The logic of the objection is that the arrest and referral were based on this interrogation. A witness doctor who has been following Marianna for a year was examined, having an image of her medical file, the examinations and surgeries that the comrade underwent. With all this image, the doctor stated that the comrade was not in a position to testify having experienced all this.

All objections were rejected after adjournment, with little justification.

Marianna tells the residents that the explosion was not the result of an organized plan. It resulted in the death of anarchist comrade Kyriakos Xymitiris and the serious injury of herself. They did not want to cause damage and destruction to people under any circumstances, while social and material conditions are already aggravated. When the anarchist political space wants to attack, it takes measures to protect people and politically the anarchist space is against the logic of collateral damage. “I will not claim that it was a conspiracy, I take political responsibility for the actions but I will not waste my freedom for things I did not do,” said comrade Marianna. The comrade also added that the death of comrade Kyriakos was slandered and that the anti-terrorist unit implied that Kyriakos would have known what would happen. Marianna stated that Kyriakos never wanted to be a burden to anyone and that he always loved life, especially that of others.

Dimitra referred to the memory of her anarchist comrade Kyriakos Xymitiris and apologized to the tenants and the owner of the apartment. She emphasized that the deprivation of her liberty was a set-up and that there is responsibility from the court if such cases are fabricated and orchestrated.

The owner of the apartment building spoke and was asked questions about what he saw. The president asks for an estimate of the damage because the damage will be repaired. Those who left the apartment building are staying in hotels. A prosecutor asked if they are receiving support from the State and the owner said no.

The residents’ lawyer says that she respects Marianna’s stance but still insists on damages because the civil part is important. The Chairman notes that the civil part does not concern us.

The lawyer of the comrade Papadakis stated that there is no expert opinion in the case file, nor have the residents seen it. For its part, the state apparatus states that it has done so. Then the lawyer of the comrade Kampayiannis argued that the entire apartment building was not put into disuse, but only a part of it.

A witness-owner of apartment C5 claims that his apartment suffered total damage and that none of the owners have received any eviction notice from the state.
