Almost eight years after the arrests for Scripta Manent, for the second time the Court of Cassation, on 24th April 2024, will pronounce judgement on the crime of “political massacre”, pursuant to art. 285 c.p., against Alfredo and myself, the last remaining fragment pending in the process (i), after a whirlwind of delays, recalculations, and repressive-jurisprudential manipulations (ii).

Although the repetition of error numbs the horror, and we are living in times of multiple horrors flaunted and total anaesthetisations, I believe there are still some words to be said about the ongoing annihilation attempt, about reactions, successful and attempted. Not so much because I believe this may be useful for our personal fates, but out of a kind of stubborn “romanticism” that considers silence and resignation always and even more lethal in a political process.

Operation Scripta Scelera: update on the trial with immediate judgement. Next hearing fixed for March 29th

On March 8th the first hearing took place of the summary trial at the court of Massa  arranged for four of the ten under investigation for Scripta Scelera. As we know, one of the comrades. Luigi, has been transferred to the prison of Bologna to have him connected via video conference. A warning to the presence of those in solidarity at the hearings and a punishment for breaking the silence imposed through restrictive house arrest with two texts. During the hearing the comrade read out a statement which had already been circulated.

The judge rejected the defence lawyers’ request for an annullity of the hearing on the basis of the decision to let Luigi participate in video conference. The civil parties appeared and witness lists were submitted: the Avvocatura dello Stato joined the civil action on behalf of the Presidency of the Council of Ministers and the Presidency of the Republic, claiming that “Bezmotivny” had damaged the State’s image and that of public administration. The expert was not commissioned to transcribe the wiretaps because the designated expert stressed the impossibility of finishing the work alone in the time available, which was six months: the judge expects to award a collegial assignment at the next hearing. In the meantime, the trial will continue without these being available. During the next hearing, the examinations of the prosecution witnesses will begin, in particular, the deputy commissioner Ardolino will be heard and inspector Canosa of the Rome department of public safety.

Responding to a parliamentary question, War Minister Guido Crosetto confirmed that the factory of Terrestrial Military Ammunition (SMMT) in Baiano di Spoleto could soon produce the new missiles and ammunition to be sent to Ukraine to support the ongoing war. The Defense Industries Agency (AID) indeed proposed three of its production sites –Spoleto, Capua and Fontana Liri – for the European Union’s tender, which provides a grant of 500 million euros to produce new armaments to be sent to Kiev.

Although it is still only a candidacy, the deal is given as very likely by the local newspapers, also by virtue of the fact that the Spoleto plant would be underutilized with respect to its “productive” (but perhaps we should say destructive) capacities.

EN/IT/ Updates for Brenner trial in Italy

Yesterday (7 March), the Court of Cassation issued its verdict for the second part (devastation and looting) of the Brenner trial.

The Supreme Court considered the statute of limitations for the crimes of aggravated personal injury aggravated, private violence, interruption of a public service and damage. The charges that therefore remain standing are aggravated theft and aggravated resistance.
Those who were sentenced to one year for the sole offence of resistance with suspended sentence have had their appeals rejected, so the convictions will now become definitive for seven people.

An appeal hearing will be scheduled to recalculate the sentences in view of the statute of limitations for most of the charges. The sentences will therefore be significantly reduced and according to calculations made by some comrades, they will not be more than three years for anyone. Therefore, no one will risk immediate arrest.

On February 14th, the hearing of the appeal trial in the so-called ‘Diamante’ case was held at the Genoa court. The judges confirmed Gianluca’s conviction for ‘illegal possession of explosives’ (art. 1 and 2 of law 895/67) and ‘attempted crime’ (art. 56 of penal code), reducing the sentence to 3 years and 2 months (plus euro 3,000). In first instance, the comrade had been sentenced to 4 years and 6 months (plus euro 15,000), while the other comrade defendant in the trial was acquitted.

Il 21 febbraio si è tenuta in corte di cassazione l’udienza sulle misure cautelari scaturita dal ricorso del PM Manotti della DDAA di Genova avverso l’ordinanza del tribunale del riesame del capoluogo ligure. Il 28 agosto le misure erano state annullate in riferimento al reato associativo (art 270 bis c. p.) e confermate, mantenendole inalterate, per le altre accuse. Il PM, in buona sostanza, ha chiesto che le misure venissero confermate anche per il reato associativo, contrariamente a quanto stabilito dal riesame. Questa richiesta, se accolta, avrebbe potenzialmente condotto in carcere gli otto compagni per i quali il GIP aveva stabilito la custodia cautelare e le restrizioni pure in relazione all’art. 270 bis c. p. La cassazione ha dichiarato inammissibile il ricorso del PM.

Here is a brief update from the website “Il Rovescio” concerning the sentence of the court of cassation of 26th January re the trial against the anarchist comrade Juan Sorroche, presently held in section AS2 of the prison of Terni, for the action against the premises of the League of Villorba (in the province of Treviso) of 12 August 2018 (two devices, the first exploded, the second unexploded and defused by police). —In the first instance trial, even after the PM removed the charge of political massacre, they sentenced me to 28 years’ prison plus 3 years’ parole.

— On Appeal they sentenced me to 14 years and 7 months, reducing it almost by half.

My lawyer has also appealed, given the sentence to 14 years and 7 months, which are not peanuts.

This is not a communique. You will not read reflections on my arrest or concerning this new prison experience, or about other political questions. These will come at the appropriate moment, that is, when I consider some personal matters settled, and some reflections have matured over these first months of detention.

This humble piece has the simple purpose – for me necessary – to thank, greet, and bring solidarity even from within these walls.

I waited a little before deciding to put down these words, even if the decision to put them on paper had already been made the evening of December 4th, day of the hearing at the court of Imperia for the fake ID found on me the day that my experience as a fugitive was ended by an operational group of the Nocs.
